The rules, and there are few

Using Your Tree means accepting these. They are short because the site is. Where they mention "we", they mean the person named in the privacy policy.

What this is

Your Tree is a free website where anyone can plant a short anonymous note that becomes a tree in a forest others can walk through. It is run by Albert Castell, Barcelona, Spain, as a personal project. There are no accounts, no fees and no advertising, and it is offered as it is.

Who can plant

You must be eighteen or older. By planting a note you confirm that you are.

What you may plant

Your own words, up to 500 characters, about anything. A note must not:

  be illegal where you are or in Spain;

  name, describe or otherwise identify a real person, or contain anyone's personal data — a name, an address, a phone number, a face in words;

• 03

  threaten, harass, or incite hatred or violence against anyone;

• 04

  sexualise minors in any way;

• 05

  be advertising, spam, or a link dropped for traffic;

• 06

  be something you have no right to publish.

Everything else stays, including the jokes, the nonsense and the things somebody will dislike. Read why.

What happens to what you plant

A note is public, permanent and anonymous. Anyone can read it, it stays as long as the forest exists, and nothing connects it to you. You cannot edit or delete it yourself, because nothing proves it is yours — that is the price of nobody being able to prove it either.

You keep whatever rights you have in what you wrote. By planting it you give us a non-exclusive, worldwide, perpetual, royalty-free licence to display, reproduce and share the note — inside the forest and outside it, including in Your Tree's own channels such as videos and social media — without attribution, because there is nothing to attribute it to. You confirm that you can grant that licence.

How a note comes down

There are exactly two ways, and the site says so in public.

  Ten different people report it. As reports arrive the tree gives less light; at ten, it falls. Nobody decides alone.

  It is flagged as naming someone or being illegal. That kind of report reaches a person at once; at three of them the tree falls on its own. If it is what the flag says, it is removed as soon as we know, which is what the Digital Services Regulation requires of us (art. 6). If it is not, it stays.

Nothing is removed because somebody dislikes it. You can flag a note from inside the note, or write to info@yourtree.net, which is also our point of contact for authorities and for anyone acting under the Digital Services Regulation (art. 12). If you write with your name and an email address, you get a confirmation that the notice arrived and, once it is decided, the decision and how to contest it.

Abuse

Planting and reporting are rate-limited per person. Flooding the forest, reporting in bulk, or using automated means to do either is not allowed, and we may block traffic that does it. If a whole batch of notes has to be removed by hand because of this, we say so in the project log.

What we do not promise

The site is offered as it is. It may be unavailable, it may change, and one day it may close; if it closes, the notes go with it. It is not a crisis service and nobody is watching it in real time — if you are in danger, contact the emergency services where you are.

Responsibility

Each note is the responsibility of the person who planted it. We host what people write and act on illegal content when notified, as an intermediary under the Digital Services Regulation; we do not check notes before they are planted and we are not their author. To the extent the law allows, we are not liable for what a note says or for any loss from using the site. Nothing here limits the rights you have as a consumer under the law of your country.

Law

These terms are governed by Spanish law. If you are a consumer in the European Union, the courts and the consumer protections of the country where you live apply where the law says so; otherwise, the courts of Barcelona.

Changes

The date at the top of this page changes when the terms do. Planting after a change means accepting the terms as they are then.
